An issue that has been hanging around for some time in the hotel sector is the regularization of waitresses’ working hours, with the aim, according to the government, of combating “very demanding working hours, which result in physical and mental strain for the workers”.
The Ministry of Labor wants to address the working times of the floor maids, known as “the Kellys”, as well as the risk of overload of tasks in the framework of a royal decree for the integration of the gender perspective in the protection of safety and health at work.
According to the text of the open public consultation prior to the drafting of this regulation, they want to develop “new provisions” for “the prevention of the risk of work overload in the activities of cleaning and tuning of rooms”.
The Ministry of Labor stresses that the aim is to combat “very demanding work times, which result in physical and mental strain for workers, thanks to a risk assessment that does not take into account the specific workload involved in the tasks they perform”.
Other measures envisaged
In addition to this, and under this regulation, the aim is to limit the setting of wage modules linked to piecework (per room) so that the part of the remuneration for results does not exceed 20% of the total wage payments.
Likewise, Labor explains, the aim is to prevent performance-related wage supplements from being penalized “on account of age or physical deterioration that may have resulted from the performance of the activity carried out”.
